Constitution

ARTICLE I
NAME AND INCORPORATION

Section 1. Name.
The name of the corporation is the Council of Air Conditioning and Refrigeration Educators, Inc (CARE). It is hereafter referred to as the "Organization".

Section 2. Location.
The principal office of the corporation shall be located in the Town of Georgetown, County of Sussex, and State of Delaware. The corporation may also have such offices at such other places within or without the State as the Board of Directors may from time to time determine.

Section 3. Incorporation.
The Organization shall be a non-profit corporation organized under the laws of the state of Delaware.

ARTICLE II
PHILOSOPHIES

Section 1. Purpose.
The purpose of the Organization is to improve the quality of education to meet or exceed established industry standards in the Heating, Ventilation, Air Conditioning and Refrigeration (HVAC/R) industry.

Section 2. Mission.
The Organizations mission is to address the needs of the industry practitioner with technical educational opportunities to acquire and maintain marketable skills and competency necessary to compete successfully in a constantly changing, technologically advancing market.

Section 3. Vision.
The Organization is dedicated to advancing the education of all industry practitioners by adopting and/or creating standards for secondary and post-secondary educational training facilities.

Section 4. Affiliation.
The Organization shall be nonsectarian and free from any political affiliation. The Organization shall be free of any discrimination by race, color, age, creed, religion, sex, ancestry, national origin, social or economic status and marital status.

ARTICLE III
IDENTIFICATION

Section 1. Logo.
The Organization shall develop, copyright and /or register an identification logo to be used by accredited training facilities with the written permission of the Organization Board of Directors.

Section 2. Use.
A. The logo may be displayed at accredited training facilities. Failure to follow required standards of accreditation shall be cause for the Board to revoke the use of the logo until accreditation is re-established.

B. All copy in which the logo or the name of the Organization is to appear shall first be submitted to the Organization and receive approval of the Board of Directors.

ARTICLE IV
MEMBERS

Section 1. Classifications.
The Organization shall be comprised of three (3) membership classes as follows:

Individual: Certified Active Member, Active Member, and Associate Member.

Training Facility: Accredited Training Facility, and Active Training Facility

Business/Trade Association: Active Member, and Associate Member

Section 2. Individual Members.
An individual member shall be a person involved or who has been involved in the education of practitioners in the HVAC/R industry. These members shall be subdivided into the following subclasses:

Certified Active Member.
This individual shall be an educator who has passed a nationally recognized HVAC/R certification exam(s) that has been accepted by the Board of Directors as quantifying the members technical expertise within the industry.

Active Member.
This individual shall be an educator who is working to pass the nationally recognized HVAC/R certification exam (s) that has been accepted by the Board of Directors as quantifying the members technical expertise within the industry.

Associate Member.
This member shall be an individual who is not working to pass the nationally recognized certification exam that has been accepted by the Board of Directors as quantifying the members technical expertise within the industry.

Proof of continued certification and/or working toward certification shall be documented as required by the Board of Directors

Section 3. Training Facility.
A training facility shall be a program actively engaged in HVAC/R industry training. These facilities shall be subdivided into the following subclasses:

Accredited Training Facility.
A training facility that has been granted accreditation as prescribed by the Organization Board of Directors.

Active Training Facility.
A training facility that is working toward certification as prescribed by the Organization Board of Directors.

Section 4. Business/Trade Association Member.
A business/trade association member shall be actively engaged in the HVAC/R industry. These members shall be subdivided into the following subclasses:

Active Business/Trade Association Member.
An active business/trade association member shall be actively engaged in promoting increased practitioner competence through educational programs as determined by the Organization Board of Directors.

Associate Business/Trade Association Member.
An associate business/trade association member shall be actively engaged in the HVAC/R industry.
